Limitations proposed by Sonny Dodson in his motion to approve
General Shale's Special Use Permit
Approved by the Board of Supervisors on April 9, 2002
1. The minimum setback/buffer for the entire boundary of said property
be 100 feet.
2. All existing trees, shrubs and other vegetation within the
setback/buffer zones set forth in Number One will be left
undisturbed.
3. White Pines (4 to 5 feet in height) will be planted in three rows
wherever there are insufficient trees to provide screening from
adjoining property ownerw who desire additional screening.
4. No topsoil removal or excavation will take place closer than 250
feet to any property line for a period of three years from the time
the tree plantings on General Shale property are completed, other
than constructing the access road.
5. The initial excavations will be made with the exposure facing
inwardly toward the center of the property. This orientation will
be continued as the operation develops so that the visibility of
the mine area and equipment will be additionally limited. This
condition shall be implemented to the extent it will not
conflict with condition #7.
6. No excavation will take place closer than twenty five feet to the
natural gas pipeline owned by Columbia Natural Gas of Virginia. No
excavation will occur in the existing pipeline easement until a
relocation of this pipeline is negotiated with its owner and
relocation is completed.
7. Any mine areas that are not yet ready for final reclamation, but
for which no activity has taken place for six months, will be
seeded as necessary within six months.
8. Should any residential water well having a depth of one hundred
feet or less located within one thousand feet of the outer
perimeter of the actual area in which General Shale is then mining,
and which is in existence on or before the date of such mining is
commenced, be impacted in terms of water quantity, said well shall
be replaced at the expense of General Shale.
9. In addition to the one hundred foot setback/buffer set forth in
condition number one, an additional one hundred foot permanent
setback/buffer will be maintained along the southernmost boundary
in the area of Careytown, from the corner with Spencer and Capelle
eastward for a distance of nine hundred feet, as shown in the
revised drawing dated March 12, 2002.
10. No mining will take place north of Blue Run as shown on the
revised map dated March 12, 2002.
11. Excavation activity shall be limited to 7:00 am to 6:00 pm Monday
thru Friday, with no excavation on holidays.
12. Mining shall be limited to those areas proposed in the General
Shale application. Mining activities outside those areas shall
not commence until such time as a special use permitted be issued
for that activity.
13. No VDOT recommendations made shall be paid for with Orange County
funds and must be in place before operation commences. All
hauling vehicles shall access the site from Rt. 20 and will not
access from Rt. 33 onto Old Barboursville Road.
